Electronic legal communication and transactions
It is also compliant for parties concerned to submit written applications to the Federal Administrative Court in an electronic form. The Court has established an 'electronic court and administrative mailbox' (EGVP) for this purpose. Lawyers may also use the 'special electronic mailbox for lawyers (beA). It is not permitted to use normal emails.
Electronic legal communication and transactions are based on section 55a of the Code of Administrative Court Procedure (VwGO). The system was established in 2004 by Ordinance of the Federal Government on the use of electronic legal communication and transactions at the Federal Administrative Court and the Federal Finance Court. The official notification of the Federal Administrative Court, issued pursuant to the ordinance, describes the procedure to register for electronic legal communication and transactions and the additional requirements that must be observed when transmitting documents by means of the electronic court and administrative mailbox.
You must install the free access and transmission software EGVP and beA on your computer to participate in electronic legal communication and transactions. You can download the programs on the Internet page for the electronic court and administrative mailbox. You are then required to register and submit a privacy statement. Electronic documents intended for submission must be converted to an approved format (e.g. PDF) and must carry a qualified electronic signature.
